Historical Warrant for Dangerous Driving Arrest 77-2-004040
On April 10, 1977, a 42 year-old male and his son, 17 years-old, were riding a motorcycle in the City of Winnipeg (Border Street & Dublin Avenue) when they were struck and killed by a vehicle that ran a red light. The vehicle was being driven by 27 year-old, Robert FOTTI of Winnipeg.
FOTTI was charged with Dangerous Driving and convicted on December 1, 1978. As a result of the conviction he was sentenced to nine months in jail.
FOTTI fled to the United States prior to being incarcerated and as such, a Canada wide Warrant of Arrest for Drive Dangerous was issued on December 30, 1980.
After illegally entering the United States, FOTTI gained resident alien status through an immigration amnesty and changed his name to Robert FOX.
In 1990, U.S. Authorities advised Winnipeg Police of FOTTI'S whereabouts, however the extradition laws did not allow the return of FOTTI.
In 2008, Police in Jacksonville, Texas arrested and charged FOTTI with Tampering with Government records which resulted in his incarceration. Due to his conviction, U.S. Citizenship and Immigration Services revoked FOTTI'S alien status.
In July 2013, the Winnipeg Police Service and RCMP became aware of FOTTI'S recent activities and members of the Manitoba Integrated Warrant Apprehension Unit (MIWAU) began a further investigation. The MIWAU contacted U.S. authorities and a decision was made to deport FOTTI based on his illegal activities in the United States.
Deportation hearings began for FOTTI, which he fought, claiming that he was not a Canadian Citizen. The MIWAU was able to locate documentation that proved FOTTI was a Canadian Citizen. The deportation hearings and appeals in the United States were concluded which resulted in a Deportation-Removal Order for FOTTI to be returned to Canada.
FOTTI was transported from Texas to the Emerson border crossing and on Tuesday, October 7, he was turned over to members of the Canadian Border Services Agency (CBSA) by U.S. Authorities. Once CBSA procedures were complete, FOTTI was turned over to members of the MIWAU with the assistance of the WPS Tactical Support Team, TEMS Medical Officer and Provincial Corrections. FOTTI was transported back to Winnipeg where he was processed on the outstanding warrant.
He has been remanded into custody.
